1. Who we are
Synara is an online marketplace run by Synara, [registration number], of [physical address], Kenya ("Synara", "we"). Contact us on the contacts on our Help page.
Shops on Synara ("agents") sell their own goods. Independent riders ("BodaKe riders") deliver them. Synara runs the website, takes payment, holds it until delivery, and arranges delivery.
2. Buying
- You order from one shop at a time, giving your name, phone number and delivery address. You do not need an account.
- The price of each item and the delivery fee are shown before you place the order. The delivery fee depends on the county you choose.
- An order holds your items for 30 minutes. If it is not paid in that time it is cancelled automatically.
- You pay by M-Pesa. Your contract for the goods is with the shop named on your order.
- Keep your order number. You need it, with your phone number, to look up the order.
3. Delivery
- When a rider has your order, your order page shows a 4-digit delivery code, and the rider's name, phone and number plate.
- Give the code to the rider only when you have received your parcel. Giving the code confirms that you received it.
- Be reachable on the phone number you gave. If the rider cannot reach you or find the address, the delivery may fail and we will contact you.
4. Cancellations and refunds
These are set out in our Refund policy, which is part of these terms.
5. Agents (shops)
- We review every application and may approve, decline or suspend an agent.
- You must own the goods you list, describe and price them truthfully, keep your stock figures correct, and sell only goods that are legal to sell in Kenya.
- Accept or reject each paid order promptly. If you reject it, the buyer is refunded in full.
- Hand the parcel only to the rider shown on the order, and give that rider the pickup code.
- Synara keeps a commission of 9% of the items total of each delivered order, up to KES 500 per order. The rest is paid to you by M-Pesa, no sooner than 24 hours after delivery.
- If a buyer's complaint about an order is upheld, the amount for that order may be withheld or recovered.
- You are responsible for your own taxes and licences.
6. Riders
- We review every application and may approve, decline or suspend a rider. You must hold the licence and insurance the law requires for your vehicle.
- You are an independent contractor, not an employee of Synara.
- Accept only deliveries you can complete. Collect with the shop's pickup code and deliver with the buyer's delivery code. Never ask a buyer for their code before handing over the parcel.
- You are responsible for a parcel from collection until it is delivered or returned.
- Synara keeps a commission of 9% of the delivery fee, up to KES 100 per delivery. The rest is paid to you by M-Pesa, no sooner than 24 hours after delivery.
- Use a buyer's name, phone number and address only to complete that delivery.
7. Accounts
Agents and riders must keep their password secret and are responsible for what is done with their account. If you forget it, call us and we will give you a reset code after checking who you are.
8. What you must not do
Do not use Synara for fraud, for illegal goods, to harass anyone, or to interfere with the website. We may cancel orders and close accounts used this way, and report them to the authorities.
9. Our responsibility
We run the marketplace with reasonable care. The shop is responsible for the goods it sells. Nothing in these terms takes away rights you have under Kenyan law, including the Consumer Protection Act, 2012. [Limits of liability to be settled with your advocate.]
10. Changes and governing law
We may update these terms and will show the date of the latest version here. These terms are governed by the laws of Kenya.
